    Housing Discrimination - Fair Housing

    The Fair Housing Act secures individuals from discrimination when they are leasing or buying a home, getting a mortgage, looking for housing support, or taking part in other housing-related activities.

    The Fair Housing Act restricts discrimination in housing since of:

    - Race.
    - Color.
    - National Origin.
    - Religion.
    - Sex.
    - Familial Status.
    - Disability.
    What Is Prohibited?

    In the Sale and Rental of Housing:

    It is illegal discrimination to take any of the following actions because of race, color, religion, sex, impairment, familial status, or nationwide origin:

    - Refuse to rent or sell housing.
    - Refuse to work out for housing.
    - Otherwise make housing not available.
    - Set various terms, conditions or privileges for sale or rental of a home.
    - Provide a person different housing services or centers.
    - Falsely deny that housing is readily available for evaluation, sale or leasing.
    - Make, print or publish any notice, declaration or ad with regard to the sale or leasing of a home that indicates any preference, limitation or discrimination.
    - Impose different prices or rental charges for the sale or rental of a home.
    - Use different qualification criteria or applications, or sale or rental requirements or procedures, such as earnings standards, application requirements, application fees, credit analyses, sale or rental approval procedures or other requirements.
    - Evict a renter or a tenant's guest.
    - Harass an individual.
    - Fail or hold-up efficiency of upkeep or repair work.
    - Limit advantages, services or centers of a home.
    - Discourage the purchase or rental of a residence.
    - Assign a person to a particular building or area or area of a structure or community.
    - For earnings, convince, or attempt to convince, homeowners to offer their homes by suggesting that people of a particular protected characteristic will move into the community (blockbusting).
    - Refuse to provide or discriminate in the terms or conditions of house owners insurance coverage since of the race, color, religion, sex, disability, familial status, or national origin of the owner and/or occupants of a residence.
    - Deny access to or membership in any multiple listing service or property brokers' organization.
    In Mortgage Lending:

    It is prohibited discrimination to take any of the following actions based upon race, color, religion, sex, special needs, familial status, or national origin:

    - Refuse to make a mortgage loan or provide other financial help for a home.
    - Refuse to supply info regarding loans.
    - Impose different terms or conditions on a loan, such as different rates of interest, points, or costs.
    - Discriminate in appraising a dwelling.
    - Condition the availability of a loan on an individual's reaction to harassment.
    - Refuse to buy a loan.
    Harassment:

    The Fair Housing Act makes it unlawful to pester persons since of race, color, religious beliefs, sex, special needs, familial status, or nationwide origin. To name a few things, this prohibits sexual harassment.

    Retaliation and Other Prohibitions:

    It is prohibited discrimination to:

    - Threaten, persuade, frighten or disrupt anyone exercising a fair housing right or helping others who exercise the right.
    - Retaliate against a person who has actually filed a fair housing complaint or helped in a fair housing investigation.
    Reasonable Accommodations and Reasonable Modifications

    Under the Fair Housing Acts a reasonable accommodation is a change, exception, or adjustment to a guideline, policy, practice, or service. The Fair Housing Act makes it unlawful to refuse to clear up lodgings to guidelines, policies, practices, or services when such lodgings may be needed to afford persons with disabilities an equivalent chance to use and delight in a residence and public and common use areas.

    In addition, the Fair Housing Act forbids a housing provider from declining to permit, at the expenditure of the person with a special needs, reasonable modifications of existing properties inhabited or to be occupied by such person if such modifications might be needed to afford such person complete enjoyment of the premises.

    What is Needed for a Grievance

    To send a housing discrimination problem these requirements must be met:

    - The residential or commercial property needs to be within the state of Texas.
    - The residential or commercial property owner, most of the times, need to have more than 3 residential or commercial properties. This does not include multi-family homes.
